Unless otherwise specified, references to “Motherly Built,” “MB World,” “we,” “our,” or “us” refer collectively to the applicable entity within the Motherly Built Group responsible for the service being provided, based on the customer’s jurisdiction and the nature of the engagement.

This Policy Pack applies across all current and future service lines offered by the Motherly Built Group, including but not limited to: Interior Design, Architecture, Construction, Exterior Design, Furniture, Apparel, Consultancy, Digital Products, AI-assisted Services, and the MB World Fellows professional network.

Note on geographic scope: Motherly Built World (design, build, construction, consultancy) currently operates in India and the United States. Motherly Built Furniture currently operates in India only. This Policy Pack is written as one worldwide standard so that as any group entity or service line expands into a new country, the same policy continues to apply — only the Group Structure section above and any country-specific compliance notes need to be updated, not the policy itself.

Part 1 — Global Privacy Policy

1.1 Introduction

This Privacy Policy explains how the Motherly Built Group collects, uses, discloses, and safeguards personal information when you visit our websites, use our services, communicate with us (including by phone, SMS, WhatsApp, or email), or engage our AI-assisted tools. It applies to visitors and customers in India, the United States, and any future jurisdiction in which we operate (including planned expansion to the UK and UAE, at which point this Policy will be updated to reflect local offices and law).

By using our services or providing personal information to us, you consent to the practices described here. If you do not agree, please do not use our services or provide personal information to us.

1.2 Information We Collect

• Personal Information: name, email address, phone number, postal address, and similar contact details.
• Payment Information: billing details processed through our payment partners (e.g., Stripe, Mercury) to facilitate transactions. We do not store full card numbers on our own servers.
• Project & Consultation Information: floor plans, site details, design preferences, budget ranges, and similar information you share for a design, build, or consultation engagement.
• Communications Data: records of calls, SMS/text messages, WhatsApp messages, and emails exchanged with our team or with our AI-assisted tools, including message content and metadata (timestamps, delivery status).
• Usage Information: IP address, browser type, device identifiers, and browsing behavior on our websites, collected via analytics tools such as Google Analytics, Google Tag Manager, Meta Pixel, and (where enabled) Microsoft Clarity.
• Cookies and Similar Technologies: as described in our Cookie Policy (Part 4).

• Providing, personalizing, and improving our design, build, furniture, apparel, and consultancy services.
• Processing transactions, orders, and deliveries.
• Responding to inquiries and providing customer support, including through AI-assisted chat and voice tools.

1.4 SMS / Text Messaging Practices (Global Standard)

Wherever we send you SMS/text messages — regardless of your country — we follow one consistent global standard: messages are sent only with your prior consent, you may opt out at any time by replying STOP, and you may reply HELP for assistance. Text messaging originator opt-in data and consent will not be shared with any third party or affiliate for marketing purposes, in any jurisdiction. Where a specific country requires additional registration or disclosures (for example, the Twilio A2P 10DLC framework applicable in the United States), we follow those local requirements in addition to this global standard. See Part 2 (SMS Messaging Terms) for full details, including message frequency and message/data rate disclosures.

1.5 WhatsApp Communications

See Part 3 (WhatsApp Messaging Policy) for how we communicate with you over WhatsApp Business Platform, including opt-out options.

1.6 AI-Assisted Services

We use AI-based tools (including AI chat assistants and AI voice agents) for customer assistance, appointment scheduling, lead qualification, and design consultation support. See Part 8 (AI Services & AI Assistant Policy) for details on how these tools process your information.

1.7 Advertising, Analytics & Third-Party Platforms

We use the following categories of third-party platforms, each governed by their own privacy terms:

• Advertising: Meta (Facebook & Instagram) Ads, Google Ads.
• Analytics: Google Analytics, Google Tag Manager, Microsoft Clarity (where enabled).
• Payments: Stripe, Mercury/Column N.A.
• Communications: Twilio (SMS), Meta WhatsApp Business Platform, voice AI platforms used for call handling.

These providers may process limited information (such as device identifiers or usage data) under their own privacy policies, strictly to help us operate and measure our services.

1.8 Disclosure of Information

We may share personal information with:

• Service providers who assist us in delivering services (payment processors, shipping/logistics partners, messaging and analytics platforms, AI infrastructure providers).
• Legal authorities, where required by law, court order, or governmental request.
• Group entities, where necessary to deliver services across India/US operations.

We do not sell personal information, and we do not share SMS or WhatsApp opt-in consent with third parties for their own marketing purposes.

1.9 International Data Transfer

Because Motherly Built operates across India and the United States (with the United Kingdom and UAE planned for the future), personal information may be transferred between these jurisdictions — for example, from a US-based customer’s inquiry being processed by our India-based design team, or vice versa. Where required, we rely on appropriate safeguards (such as contractual protections with our processors) for such transfers, in line with applicable law including India’s Digital Personal Data Protection Act, the EU/UK GDPR (for any future UK operations), and the US CCPA (for California residents).

1.10 Your Rights and Choices

Depending on your location, you have the right to:

• Access, correct, update, or request deletion of your personal information.
• Opt out of marketing communications (email, SMS, or WhatsApp) at any time.
• Disable cookies through your browser settings.
• Request a copy of the personal data we hold about you.
• (California residents) exercise rights available under the CCPA, including the right to know and the right to opt out of the sale/sharing of personal information — noting that we do not sell personal information.

Part 2 — SMS Messaging Terms (Global Standard)

2.1 Program Description

Motherly Built operates one worldwide SMS messaging standard, applied consistently regardless of the country you are contacted in. Motherly Built (through the applicable group entity — Motherly Built World Pvt. Ltd., Motherly Built World LLC, or a future country entity) may send SMS text messages to individuals who have opted in, related to appointment scheduling, project updates, consultation follow-ups, and — where separately consented to — promotional offers.

In addition to this global standard, we comply with local regulatory frameworks where applicable — for example, the Twilio A2P 10DLC registration and disclosure requirements in the United States. As Motherly Built expands to new countries, this same standard will apply there too, supplemented only by whatever local registration/compliance framework that country requires.

2.2 Consent

By providing your phone number and opting in (via a form, verbal consent on a call, or reply to an initial message), you consent to receive SMS messages from Motherly Built. Consent is not a condition of any purchase.

2.3 Message Frequency

Message frequency varies depending on your engagement with us (e.g., active project updates vs. general inquiries) and may range from a few messages per month to more frequent updates during an active project.

2.4 Message and Data Rates

Message and data rates may apply, depending on your mobile carrier and plan. Motherly Built is not responsible for any charges from your carrier.

Carriers are not liable for delayed or undelivered messages. Not all carriers may be supported.

Part 3 — WhatsApp Messaging Policy

3.1 Overview

Motherly Built may communicate with you via WhatsApp Business Platform (operated by Meta) for appointment confirmations, project updates, design consultation follow-ups, and customer support, where you have initiated contact with us or opted in.

3.2 Meta Platform

WhatsApp communications are subject to Meta’s own terms and privacy practices in addition to this Policy. We do not control WhatsApp’s underlying infrastructure and are not responsible for its availability.

3.3 Opt-Out

You may opt out of WhatsApp communications at any time by replying “STOP” in the chat or notifying our team directly.

By using the services provided by the Motherly Built Group — spanning Interior Design, Architecture, Construction, Exterior Design, Furniture (MB Furniture), Apparel, Consultancy, Digital Products, and AI-assisted Services — you agree to these Terms & Conditions. If you do not agree, please do not use our services.

5.2 Intellectual Property

All content, designs, logos, trademarks, and other intellectual property on our websites and in our deliverables are the property of the Motherly Built Group and protected under applicable copyright and trademark law (see Part 9 for full detail). You may not use our intellectual property without express written consent.

5.3 Orders, Consultations, and Payment

By placing an order or engaging our consultancy/design/build services, you agree to provide accurate and complete information. Payment must be made in accordance with the payment methods and terms specified in your project agreement or invoice, processed via our payment partners (Stripe, Mercury, or bank transfer as applicable).

5.4 AI-Assisted Services

Where AI tools are used to assist with scheduling, initial consultation, or customer support, outputs are provided for informational/assistive purposes and do not constitute final design, engineering, or legal advice. Final deliverables are reviewed by our human design and engineering team. See Part 8 for details.

5.5 Returns, Refunds, Cancellation, and Shipping

Governed by our Cancellation & Refund Policy (Part 6) and Shipping & Delivery Policy (Part 7).

5.6 Limitation of Liability

To the maximum extent permitted by law, Motherly Built shall not be liable for indirect, incidental, or consequential damages arising from the use of our website or services, beyond amounts actually paid for the relevant service.

5.7 Governing Law

For services delivered by Motherly Built World Pvt. Ltd. (India), these Terms are governed by the laws of India, with courts at Noida/Gautam Buddh Nagar, Uttar Pradesh having jurisdiction. For services delivered by Motherly Built World LLC (USA), these Terms are governed by the laws of the state in which Motherly Built World LLC is organized, without regard to conflict-of-law principles.

5.9 SMS Text Messaging Program

• Program Name: Motherly Built SMS Notification & Consultation Program
• Program Description: Motherly Built sends SMS text messages to individuals who have opted in, for appointment scheduling, project/consultation updates, and follow-ups related to our design, build, furniture, and consultancy services.
• Message Frequency: Message frequency varies and is recurring based on your engagement with us (e.g., active project updates).
• Message and Data Rates: Message and data rates may apply.

Part 6 — Cancellation and Refund Policy

(Applies across Motherly Built World and Motherly Built Furniture)

6.1 Order Cancellation

Customized Products/Services:

• Within 24 hours of order: full refund.
• After 24 hours, before design/production begins: 25% cancellation fee; remainder refunded.
• After design/production has commenced: no cancellation, no refund.

Non-Customized Products/Services:

• Within 24 hours of order: full refund.
• After 24 hours, before shipment: 10% cancellation fee; remainder refunded.
• After shipment: no cancellation, no refund.

6.2 Refund Policy

Customized Products/Services: Defective or damaged items are replaced (including shipping charges); refunds are not issued for customized products.

Non-Customized Products: Defective or damaged items are replaced or fully refunded (including shipping charges). Non-customized products may be returned within 7 days of delivery for a full refund, provided they are unused, in original packaging, and in saleable condition. Return shipping is the customer’s responsibility unless the product was defective or damaged.

6.3 Process

To cancel an order, contact our support team with your order number and reason for cancellation. Approved refunds are processed within 7–10 business days to the original payment method.

6.4 Exceptions

Orders placed during promotional periods or for specially discounted items may carry different cancellation/refund terms, stated clearly at the time of purchase.

Part 7 — Shipping and Delivery Policy

7.1 Motherly Built Furniture (MB Furniture)

Delivery timelines depend on order complexity:

• 1–7 days: smaller/less complex orders.
• 7–10 days: standard customized orders.
• 10–15 days or more: larger/intricate customized projects.

7.2 Motherly Built World (MB World) — Turnkey Projects

Delivery timelines follow the project scope, timeline, and payment terms outlined in the signed project contract.

7.3 Important Notes

• Custom orders: timelines depend on project complexity; we will communicate any delays proactively.
• Delivery areas: we currently deliver across major regions and cities; remote locations may require additional time.
• Tracking: tracking information is shared once an order is dispatched.

Part 8 — AI Services & AI Assistant Policy

8.1 Use of AI

Motherly Built uses AI-based tools — including AI chat assistants and AI voice agents — for customer assistance, appointment scheduling, lead qualification, and initial design consultation support.

8.2 Nature of AI Output

AI-generated responses are intended to assist and inform; they do not constitute final architectural, structural, engineering, or legal advice. All final designs, quotations, and construction plans are reviewed and approved by our qualified human team before execution.

8.3 Data Processing by AI Tools

Information you share with our AI assistants (chat or voice) is processed to respond to your inquiry and may be stored to improve service quality and follow up with you, consistent with Part 1 (Privacy Policy). We do not use your conversation data to train third-party public AI models.

8.4 Human Oversight

You may request to speak with a human team member at any point during an AI-assisted interaction.

Part 9 — Copyright & Intellectual Property

9.1 Ownership

All website content, design portfolios, drawings, renders, logos, trademarks, and written material are the property of the Motherly Built Group unless otherwise credited, and are protected under Indian and international copyright and trademark law.

9.2 Client Deliverables

Ownership and usage rights of final design deliverables (drawings, BOQs, renders) provided to a client are governed by the specific project agreement signed between the client and Motherly Built.

9.3 Restrictions

You may not reproduce, distribute, or create derivative works from our intellectual property without express written consent from Motherly Built.

Part 10 — Acceptable Use Policy

You agree not to:

• Use our website, SMS, WhatsApp, or AI-assisted channels to send unlawful, abusive, or fraudulent content.
• Attempt to gain unauthorized access to our systems, data, or accounts.
• Use our services to violate any applicable law or third party’s rights.
• Scrape, copy, or misuse content from our website for commercial purposes without permission.

We reserve the right to suspend access to any individual found in violation of this policy.
